US judge blocks Trumpβs newest order limiting birthright citizenship
A federal judge has blocked the Trump administration from enforcing a new executive order that would limit birthright citizenship eligibility. U.S. District Judge Deborah Boardman in Maryland issued the preliminary injunction Wednesday at the request of immigrant rights advocates.
This marks the second legal challenge to Trump's birthright citizenship efforts. The U.S. Supreme Court rejected his initial 2025 executive order on June 30, ruling in Barbara v. Trump that it violated the 14th Amendment's citizenship clause. That clause grants citizenship to those born in the United States who are "subject to the jurisdiction thereof."
The Trump administration's original order would have excluded children whose parents were neither U.S. citizens nor legal permanent residents (green card holders) from automatic birthright citizenship.
